Background:

 

In accordance with Chapter VI; Section 1 of the Town Charter:

 

The Mayor shall, with the approval of the Town Council, appoint Attorneys for the Town. The Mayor may, with the approval of a two-thirds (2/3) majority of the Town Council, remove attorneys that have been appointed for the Town. 

 

 

The Town Attorney(s) shall be an attorney-at-law admitted to practice law in the State. He shall appear for and protect the rights of the Town in all actions, suits, or proceedings brought by or against it or any of its department, officers, agencies, boards, or commissions. He shall be the legal advisor of the Town Council, the Mayor, and all Town officers, boards and commissions in all matters affecting the Town and shall, upon written request, furnish them with a written opinion on any question of law involving their respective powers and duties. Upon request, he shall prepare or approve forms of contracts or other instruments to which the Town is a party or in which it has an interest.  He shall have power, with approval of the Town Council, to appeal from orders, decisions, and judgments and, subject to the approval of the Town Council, to compromise or settle any claims by or against the Town.

 

The Town Attorney shall receive compensation as fixed by the Town Council.

If in special circumstances or for any investigation under Chapter III, Section 9, the Town Council deems it advisable, it may provide by resolution for the temporary employment of counsel other than the Town Attorney.
